Managing a house in multiple occupation (HMO)

Anyone who manages an house in multiple occupation of any size has a duty of care to occupiers, including:

• providing information about the property
• taking safety measures
• maintaining water supply and drainage
• maintaining gas and electricity supplies
• maintaining common parts and living accommodation
• providing waste disposal facilities

Failing to manage an HMO effectively is an offence leading to fines on conviction. We we may issue a civil penalty notice for relevant offences, which carry a maximum fine of £30,000.

HMOs have their own set of regulations, The Management of Houses in Multiple Occupation (England) Regulations 2006.

Premises must be free from significant hazards. These are assessed using the Housing Health and Safety Rating System (HHSRS) under the Housing Act 2004.
