Street trading consent

Street trading is the selling (or offering for sale) of items in public spaces, which includes:

  • roads
  • footways
  • other areas the public have access to without payment (including service stations)
  • privately owned areas that are publicly accessible, for example:
    • shopping centres
    • car parks
    • open spaces

Examples of street trading includes food stalls, catering vans and other mobile setups.

If you're serving food, you will need to register a food business.

We're reviewing street trading regulations

We’re currently reviewing street trading arrangements.

We've now agreed a proposed resolution to adopt new street trading consent controls. This was under Schedule 4 of the Local Government (Miscellaneous Provisions) Act 1982, and agreed on 26 November 2025.

The new arrangements will replace the 4 current separate regimes with a single unified approach. Under the proposed changes, street trading controls will only apply to highway areas we maintain, with exemptions for community focused events.

Submit your comments by 30 January 2026.

We'll make a final decision on the changes in April 2026. If they're agreed, the new arrangements will take effect in October 2026.
